USE OF NYC FACILITIES

Yacht Club activities take precedence over all other uses of facilities.

1. Authorization to use NYC facilities does not imply endorsement or approval of any group or activity.
   .
2. The NYC Board of Directors shall be responsible for establishing criteria for the use of NYC facilities.

Users of NYC facilities pursuant to this policy shall comply with the following procedures.

PROCEDURES FOR USE OF NYC FACILITIES

All users will:

1. Pay all fees in advance of use.
2. Ensure that no unauthorized third party will be granted permission to use the facility or any portion thereof without prior approval.
3. Ensure that participants will not be restricted from participation for reasons of race, religion, sex, creed, national origin, or handicapping condition.
4. Ensure that the representative specified in the contract as responsible for NYC facilities is present at the scheduled event.
5. Ensure that prior approval is received before signs, banners, and pennants are erected, and that they do not deface NYC property.
6. Ensure that the number of attendees does not exceed the authorized capacity of the facility.
7. Ensure that participants' vehicles are parked only in areas designated for parking.
8. Ensure that usage and users are restricted to assigned areas.
9. Allow drinking of alcoholic beverages only in areas designated for drinking and only after the completion of a signed Indemnification And Hold Harmless Agreement in advance of the event.
10. Guarantee that activities will be orderly and lawful and not of a nature to incite others to disorder, and demonstrate on the application that reasonable security arrangements appropriate for the use have been provided for.
11. Prohibit smoking in the facility.
12. Ensure that alcoholic beverages are not served or consumed in the facility or on the grounds without a permit obtained from the liquor commission.
13. Ensure that gambling is not permitted.
14. Not allow animals inside the facility or on the grounds. If, by express permission, animals are permitted inside of the facility or on the grounds, users will clean any facility grounds used by animals.
15. Observe contracted time limits.
16. Leave the building and grounds in a neat and orderly condition.
17. Ensure reimbursement for the cost of damages occurring during use.
18. Agree to hold harmless and indemnify the Nawiliwili Yacht Club with respect to any claim of loss, injury, or damage because of negligence of the user or user's employees or agents, including damage to NYC property or property for which the NYC is liable. (An insurance policy for such coverage is recommended and may be required.)
19. Comply with safety procedures and policies of the NYC and the county fire department.
20. Comply with all federal, state, and local laws, regulations, and licensing requirements.
21. Not allow political or religious gatherings without express permission to do so.
    
    I have read all of the above procedures for use of the NYC facilities and agree to abide by them.
