POLICY ON USE OF NAWILIWILI YACHT CLUB VESSELS

GENERAL STATEMENT
The Nawiliwili Yacht Club (NYC) owns and maintains a fleet for use by the membership and for instructional purposes. This policy clarifies the conditions for use of the NYC fleet by the membership. The fleet currently consists of seven (7) boats: one (1) Holder, four (4) Lasers, one (1) 12 ft. hard shell inflatable and one (1) Boston Whaler.

QUALIFICATIONS
Prior to any use of the NYC Sailboat, a waiver must be signed, in which the user agrees not to hold the NYC liable for any injury, death or property damage that may result from the use of the NYC Sailing Program equipment. A member may qualify to check out a NYC-owned sailboat following demonstration of proficiency. The demonstration of proficiency can be arranged with one of the NYC Sailing Program personnel authorized by the NYC Board for that purpose. In general, the demonstration of proficiency is intended to ensure that a member has sufficient skill in general boating safety and small boat sailing.

After a member has demonstrated proficiency in sailing, the member may request access to the boat storage area so they may check out one of the NYC Sailboats for their personal use. In order to gain access to the storage area, the member must agree to comply with all Sailing Program rules. The rules govern where and when the sailboat may be used, procedures for checking out the sailboat and responsibility for damage, etc.

The Boston Whaler is intended for limited use only by Club members at the discretion of the Fleet Captain. NYC boats shall not be transported beyond Nawiliwili Harbor without written permission of the Fleet Captain and two Board Members.

SAILING PROGRAM ADMINISTRATION
The NYC Sail Program shall be under the direction of the Fleet Captain who shall also be responsible for establishing procedures to promote sailing, including sailing instruction and racing. Priorities for the use of the boats are in the order of 1) instructional use in NYC sponsored classes, 2) racing in NYC sponsored events, and 3) all other personal use by members. In the event that more people desire to use the NYC fleet than there are boats available, the Fleet Captain will establish a fair procedure that accommodates as many members as possible.

The NYC Board of Directors shall approve rules for use of the NYC Fleet. Failure to comply with the rules may result in discontinuation of a member's rights to participate in the NYC Sailing program.

NAWILlWILl YACHT CLUB SAILING PROGRAM RULES

  1. NYC Sailboats may be used by NYC members subject to the sign-in and check-out procedures established by the Fleet Captain.

  2. All users shall wear a USCG approved Personal Flotation Device (PFD).

  3. NYC Sailboats sailed out from the NYC clubhouse are not to be sailed outside of Nawiliwili Harbor.

  4. NYC Sailboats may only be sailed during daylight hours.

  5. The Sailboats are to be fully unrigged and completely put away by the user after each use. This includes proper stowing of equipment, folding sails, washing down hull, etc.

  6. Each person checking out a sailboat is responsible to observe that all equipment is in proper working condition when rigging the boat. All equipment should be returned in proper working condition.

  7. It shall be the responsibility of each user to report any damaged or lost items to the Fleet Captain so it can be repaired or replaced.

  8. Each person checking out a sailboat is responsible for any damages to the boat, other property (in the event of a collision), or any damaged, lost or stolen equipment that may occur while they are using the boat.

  9. Any person authorized to sail a NYC boat by themselves who is under the age of 16 shall be under the supervision of a parent or guardian or a NYC instructor.
